This particular page describes all the terms and conditions unconditionally in effect upon requesting the use of this official website and all the services available on it. By using any of the Website Services or the Website as a whole, you (the Applicant) inadvertently agree and without any qualification or limitation, to be bound by the points mentioned herein and by any other alternative terms mentioned elsewhere on the Website.

The applicant should be aware that we reserve the right to change, add, delete, update or modify any information, in whole or in part, in our sole discretion. Please continue to check this page regularly for any such changes. If the Applicant does not agree in any way with the terms and conditions mentioned herein, the Applicant is requested not to use the Service website PardonQuebec.ca

By applying for a record suspension, lifting of a U.S. entry ban or Canadian pardon, the applicant agrees to:

Authorization

Site owners PardonQuebec.ca are authorized, upon acceptance of the application, to act on behalf of the applicant to obtain a pardon for their Canadian criminal record or to acquire the exemption from entry into the United States. The company is also authorized to communicate with all governments and related organizations that the company believes will contribute to the procurement process. The company is also authorized to take all necessary measures to assist the applicant in this matter and, if necessary, also to refer the file to legal counsel who would also be competent to act on behalf of the applicant.

Removal of Lockers

Once all fines and terms have been paid in full by the applicant and the eligibility threshold has been met, record expungement takes approximately two years to destroy or expunge all Canadian criminal records, depending on the crime. This schedule is subject to change at the discretion of the government’s signing authority. Any kind of unpaid terms or fines will eventually stop or slow down the entire process. PardonQuebec.ca can only confirm that the fines are unpaid once the court documentation has been received.

The company has no authority to delete incident reports, which are automatically deleted free of charge, as soon as they are eligible. This also includes certain offences that appear on a police certificate or are listed on the Sex Offender Registry. In case it is necessary, the applicant is responsible for obtaining the report(s) from the local police and even paying the applicable processing fee for the police and the federal government.

U.S. Entry Waiver

Once all fines have been paid in full by the applicant and the documents have been received, the preparation of the waiver request and the final decision by U.S. Customs and Border Protection takes approximately ten months. This is subject to change at the sole discretion of the signing authority. Any unpaid fines would eventually slow down or even stop the process.

U.S. Customs and Border Protection requires all applicants to submit the U.S. Entry Waiver Application Form in person and pay the fee. The application form must include all original documents. In the event that the applicant is unable to submit the documents for the U.S. entry waiver or to pay the associated fees within the allotted time, U.S. Customs and Border Protection is responsible for charging an additional fee to update the expired documents.

IGeneral Information

As your case progresses towards the deletion of the criminal record, any outstanding balance will be charged to the applicant’s credit card listed in the files. However, the application fee must be paid within the first four months of the initial payment. The claimant may also be asked to pay an overdue balance if there are outstanding balances and the aforementioned fine would increase over time.

The amount paid to PardonQuebec.ca is typically used to pay for various disbursements and government fees that are required to gather the necessary documentation and information. They are also required to communicate with the various government agencies involved in the procedure. The final decision, however, rests solely with the government. Some things you need to note here are:

  • Government fees are subject to change without notice.
  • Federal legislation is also subject to change without notice. The applicant should note that there would be no refund if the legislation were to change its status. However, additional fees may be charged due to changes.
  • The federal government has recently replaced the word “Pardon” with “Record Suspension” and, as a result, the effects of the Record Suspension are interchangeable.
  • Application files are handled with care within the boundaries of the PardonQuebec.ca office. However, the Board has no control over the PBC (Parole Board of Canada), statutory eligibility dates, policy, or the U.S. or Canadian government approval process.
  • In the event that the applicant initiates an application without PardonQuebec.ca and the company later discovers that you are not eligible for a pardon application, we are required to cancel your application without any information or refund of any kind.

The Applicant’s Liability

When considering a Canadian Pardon or a U.S. Entry Waiver, the applicant is responsible for:

  • Contact PardonQuebec.ca in case you change your contact information.
  • Comply with all requests for documents made by the company. If you fail to do the same, your application could be destroyed and the process would have to start all over again. More details on the subject can be found in our Privacy Policy.
  • To act with respect with all employees working at PardonQuébec.ca. Any form of abusive behaviour directly affects the processing of your file and will result in the cancellation of your application without refund.
  • Notify the company in case you are arrested or charged with a crime before the end of your application.
  • The company is also required to receive the final decision from the court and new charges would also negatively impact your eligibility to receive pardons.

Involvement of Third-Party Websites

The Website may contain links to third-party websites. Such links are provided solely as a convenience to you and are not an endorsement by PardonQuebec.ca. The Company is not responsible for the content displayed on these websites and makes no warranty as to the accuracy of the content presented therein. In the event that you access these, you do so at your own risk.

IIndemnification

Claimant shall defend and indemnify PardonQuebec.ca (including all third-party websites referred to herein) from and against such claims and demands, without limitation, related to:

  • Your Breach of These Terms and Conditions
  • Your Access to and Use of the Website
  • Your postings, communications, and reliance on the Website or any Service.

You would therefore use your best efforts to cooperate with the Website in the defense of any such claim. At its own expense, PardonQuebec.ca assumes sole control and defense of any matter that might otherwise be subject to indemnification by you.

All logos, service marks or icons provided on the Website are trademarks of the PardonQuebec.ca. In addition, the navigation, information, and design of the website are also protected by the copyright of the website.

Termination

PardonQuebec.ca reserves all rights to terminate or suspend your application and access to the Website without notice or limitation at any time if:

  • Credit card details are not valid.
  • The company receives false information from you.
  • The company does not receive the payment due.
  • The company decides, in its sole discretion, that you do not agree to the terms and conditions, and therefore do not abide by them.
